Terms of Service

These Terms of Service ("Terms") govern your purchase and use of AviatorWP ("the Product"), a WordPress theme created by Dave Bloom ("we," "our," or "us"). By purchasing or using AviatorWP, you agree to be bound by these Terms.
1. License Grant
Upon purchase, we grant you a non-exclusive, non-transferable license to:
- Install and use AviatorWP on the number of websites specified by your license tier
- Modify the Product for your own use
- Receive updates and support as specified by your license
GPL Compliance
AviatorWP is licensed under the GNU General Public License v2 or later (GPL) as required for WordPress themes. This means the PHP code is open source. However, your license key is required to receive updates, support, and access to our services.
2. Restrictions
You may NOT:
- Redistribute, resell, or sublicense the Product
- Share your license key with others
- Use the Product on more sites than your license permits
- Remove or alter any proprietary notices or labels
- Use the Product for any unlawful purpose
3. Refund Policy
We offer a 14-day refund policy from the date of purchase. Refunds are available if:
- The Product does not function as described
- You are unable to use the Product due to technical issues we cannot resolve
Refunds may be declined if:
- More than 14 days have passed since purchase
- The Product has been used on a live/production website
- You have violated these Terms
To request a refund, contact us at email@aviatorwp.com with your order details and reason for the request.
4. Updates and Support
Your license includes:
- Updates: Access to Product updates for the duration of your license
- Support: Email support for installation, configuration, and bug-related issues
Support does NOT include:
- Custom development or modifications
- Third-party plugin or theme conflicts
- Server configuration or hosting issues
- Training or tutorials beyond our documentation
5. License Renewal
After your license period expires:
- You may continue using the version you have installed
- You will no longer receive updates or support
- You may renew your license to restore access to updates and support
6. Intellectual Property
AviatorWP, including its code, design, documentation, and branding, is owned by Dave Bloom and protected by copyright and other intellectual property laws. The GPL license applies to the PHP code only; other assets (CSS, JavaScript, images, documentation) may have different licensing terms.
7. Disclaimer of Warranties
THE PRODUCT IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.
We do not warrant that:
- The Product will meet your specific requirements
- The Product will be uninterrupted, timely, secure, or error-free
- The results obtained from using the Product will be accurate or reliable
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PRODUCT.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT.
9. Indemnification
You agree to indemnify and hold harmless Dave Bloom and AviatorWP from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Product or violation of these Terms.
10. Termination
We may terminate or suspend your license immediately, without prior notice, if you breach these Terms. Upon termination:
- Your license rights will cease immediately
- You must stop using the Product on all websites
- No refund will be provided for terminated licenses
11. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or posted on our website. Your continued use of the Product after changes constitutes acceptance of the new Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions.
13. Dispute Resolution
Any disputes arising from these Terms or your use of the Product shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration or in the courts of Ontario, Canada.
14. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
15. Entire Agreement
These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and us regarding the Product.
